MSPA Registration


The very first thing you must do to become a FLC or renew a license is to submit a farm labor contractor registration with the U.S. federal government (Department of Labor).


FLC Registration Requirements

DLL FLC helps aspiring FLCs and renewal FLCs to meet all federal requirements of the MSPA certification process.

    US DOL Wage and Hour Division issue registration certificates to farm labor contractors and their supervisors.

    Orange Card

    “Orange card” registration certificates are issued to Farm Labor Contractor (FLC) companies or sole proprietors. An “orange card” shows that a FLC is authorized to Furnish, Recruit, Employ, Solicit, Hire, Transport and/or House agricultural workers.

    • Orange Card holders can be verified at the MSPA DOL website here. This list of Orange Card holders is updated by DOL a few times per year.

    Blue Card

    “Blue Card” registration certificates are issued to farm labor contractor employees (FLCE) who supervise or drive agricultural workers under a registered FLC (“Orange Card”). If you employ H-2A workers, only a registered FLC employee (“Blue Card”) can be authorized to drive workers.

    • Blue Card holders can be verified at the MSPA DOL website here. This list of Blue Card holders is updated by DOL a few times per year.

     

    *Card holders whose certifications are not current (ineligible) are also listed on the DOL website links above. DLL FLC helps our clients acquire the proper cards and authorizations to legally operate in the State of California.

    DOL Application


    As a one stop shop, DLL FLC will handle all of the paperwork for applicants and send their applications to the DOL on their behalf.

    Transportation


    In order to transport farm workers, FLCs must be authorized to transport and FLCEs must be authorized to drive. DLL FLC can guide you through all aspects of getting proper registrations, passing vehicle inspections, and applications so that your vehicles and drivers are properly authorized to transport workers.     Transportation violations are one of the number one reasons why FLCs and their grower clients receive fines and penalties from US DOL. DLL FLC is here to help guide you and your company.

    Housing


    FLCs must be authorized by the US DOL in order to provide housing for agricultural workers. Housing authorization is also a pre-requisite to receive a permit for H-2A workers. Housing authorization can be a challenge and DLL FLC is happy to help walk you through the process.

    Criminal Background Check & Live Scan Fingerprints


    All applicants must provide fingerprints and undergo a criminal background check as part of the registration process. DLL FLC is happy to schedule the time and place for fingerprinting on behalf of our clients.
